Terms of Service
1. Who we are
TrailStack is a curated GPX track and roadbook marketplace for adventure riders and creators, available at trailstack.app.
References to “TrailStack,” “we,” “us,” or “our” in these Terms refer to the operator of trailstack.app.
2. Acceptance of terms
By accessing or using trailstack.app, creating an account, purchasing a route, or uploading content, you agree to these Terms of Service and our Privacy Policy.
If you do not agree, do not use the platform.
These Terms constitute a legally binding agreement under Belgian law.
3. Accounts
3.1 Registration
You may register as a rider, a creator, or both. You agree to provide accurate, current, and complete information and to keep it updated.
3.2 Account security
You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately at hello@trailstack.app if you suspect unauthorised access.
3.3 Termination by you
You may delete your account at any time via your account settings or by contacting us. Deletion removes your profile and personal data subject to our retention obligations (see Privacy Policy).
3.4 Termination by us
We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, abuse the platform, or if required by law. We will give reasonable notice unless immediate action is necessary.
4. Rider terms
4.1 What you're buying
When you purchase a route or subscribe, you receive a personal, non-exclusive, non-transferable licence to download and use the route files (GPX, PDF roadbook, TerrapiRata) for your own personal riding purposes.
4.2 What you may NOT do
- Redistribute, resell, or share purchased route files with others
- Upload purchased routes to other platforms
- Use purchased routes for commercial purposes without written permission from the creator
- Attempt to reverse-engineer or scrape the platform
4.3 Subscription — fair use
The subscription provides unlimited downloads subject to fair use. We reserve the right to limit or suspend accounts that download in bulk with no reasonable personal riding purpose (e.g. bulk-download-then-cancel behaviour). We will contact you before taking action where possible.
4.4 Explorer tier
The Explorer tier is free and provides full browsing access, downloads of free routes, and the ability to purchase individual routes à la carte. It does not include unlimited downloads. It is not a limited subscription.
4.5 Refunds
Route purchases are digital goods delivered immediately upon payment. Under Belgian consumer law (Book VI of the Code of Economic Law) and the EU Consumer Rights Directive, you acknowledge that by downloading a file you waive your right of withdrawal in respect of that specific digital content. Refunds are granted at our discretion where a route is materially misdescribed or technically defective. Subscriptions are non-refundable for the current billing period; you may cancel at any time to prevent renewal.
4.6 Accuracy of routes
Routes are created by independent creators and screened by our AI access tool. We do not guarantee that routes are free from legal access issues, road closures, or physical hazards. Always verify local regulations before riding. TrailStack accepts no liability for personal injury, property damage, or legal consequences arising from use of any route.
5. Creator terms
5.1 Eligibility to upload
You must have personally ridden or verified the routes you upload. You must not upload routes that you do not have the right to distribute.
5.2 Content ownership
You retain full ownership of the routes and content you upload. By uploading, you grant TrailStack a worldwide, royalty-free, non-exclusive licence to host, display, process, and distribute your content to riders on the platform for as long as the content remains published.
5.3 Pricing
You set your own price per route. There is no maximum price. Routes priced significantly above typical market rates are subject to internal review; routes whose price is not justified by content quality, length, documentation depth, region rarity, or multi-day complexity may be removed.
5.4 Content standards
You must not upload:
- Routes that traverse protected areas where motorised access is prohibited, without clearly disclosing this
- Routes containing deliberately misleading or dangerous information
- Content that infringes third-party intellectual property rights
- Content that is illegal in Belgium or in the jurisdiction where the route is located
Violations may result in content removal and account termination without prior notice.
5.5 AI access screening
All uploaded routes are screened by our AI access tool (currently in beta) before publication. This tool may produce false positives. You may dispute a flagged route by contacting us. The screening does not guarantee legal compliance — responsibility for route accuracy remains with the creator.
5.6 No exclusivity
We do not require exclusivity. You may distribute your routes on other platforms simultaneously.
6. Payments
All payments are processed by Stripe. By making purchases on the platform, you also agree to Stripe's Terms of Service (stripe.com/legal). Full payment terms, creator revenue splits, and payout details will be published at launch.
7. Intellectual property
7.1 Platform IP
The TrailStack platform, brand, logo, software, and design are owned by the operator of trailstack.app. Nothing in these Terms grants you any rights to these.
7.2 Creator content
As stated in Section 5.2, creators retain ownership of their uploaded content. TrailStack's licence to that content terminates if the creator deletes it or closes their account, subject to existing rider download licences for already-purchased content.
7.3 Feedback
If you submit ideas, suggestions, or feedback about the platform, you grant us the right to use that feedback without compensation or obligation to you.
8. Prohibited conduct
You must not:
- Use the platform for any unlawful purpose
- Scrape, crawl, or systematically extract content from the platform
- Attempt to gain unauthorised access to any part of the platform or another user's account
- Upload malware or malicious code
- Impersonate another person or entity
- Engage in conduct that disrupts or damages the platform or other users' experience
- Circumvent any technical access controls or the subscription fair-use policy
9. Disclaimers and limitation of liability
9.1 Platform availability
We aim for high availability but do not guarantee uninterrupted access. We are not liable for downtime, data loss, or service interruptions beyond our reasonable control.
9.2 Route accuracy
As stated in Section 4.6, routes are user-generated. We screen for access issues but cannot guarantee accuracy. Use routes at your own risk.
9.3 Limitation of liability
To the maximum extent permitted by Belgian law, TrailStack's total liability to you for any claim arising under or in connection with these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
We are not liable for indirect, consequential, or incidental damages, loss of profits, or loss of data.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, or for intentional misconduct or fraud.
10. Indemnification
You agree to indemnify and hold harmless TrailStack and its operators from any claims, damages, or costs (including reasonable legal fees) arising from your breach of these Terms, your uploaded content, or your use of the platform in violation of applicable law.
11. Modifications to the platform and terms
11.1 Platform changes
We may modify, suspend, or discontinue features of the platform at any time. We will give reasonable notice for material changes that affect paid services.
11.2 Terms changes
We may update these Terms. Material changes will be notified by email (if you have an account) and by updating the “Last updated” date. Continued use after the effective date constitutes acceptance.
12. Governing law and disputes
These Terms are governed by Belgian law.
Any dispute arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Belgium.
If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in the courts of your country of residence under EU consumer protection law.
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr which you may use for disputes relating to online purchases.
13. Consumer rights (EU)
If you are a consumer within the EU, nothing in these Terms affects your statutory rights under applicable consumer protection law, including the EU Consumer Rights Directive and Belgian consumer law (Book VI of the Code of Economic Law).
14. Severability
If any provision of these Terms is found to be unenforceable by a competent court, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions continue in full force.
15. Entire agreement
These Terms and our Privacy Policy constitute the entire agreement between you and TrailStack regarding your use of the platform, and supersede any prior agreements or representations.
